Saudi Arabia`s Ministry of Justice and the Ministry of Human Resources and Social Development recently inaugurated the Unified Employment Contract. It will regulate the contractual relationship between employers and employees in accordance with the Labour Law rights and obligations giving them legal binding.
Ministry of Justice Launches Unified Employment Contract
The Unified Employment Contract is part of a series of authenticated electronic contracts recently announced by the Ministry of Justice. Other documents include the Unified Lease Contract, Vehicle Leasing Contract, Private School Student Registration Contract, Unified Attorney Fee Contract and Complete Construction Contract. Accordingly, these contracts are now classed as executive documents that contribute to achieving preventive justice and preserving rights. In addition, the new system will reduce the volume of disputes in courts and promote values of justice and transparency. Furthermore, the new procedure is expected to enhance trust and stability in the labour market while simultaneously improving investor confidence.
Wage Clause Added To Employment Contract
In associated news, Saudi Arabia announced the adoption of a wage clause in the notarised employment contract as an enforceable document. This qualitative step will enhance rights protection in the labour market and consolidate principles of commitment and fairness between parties. Moreover, this step will be achieved through the technological link between the Qiwa and Najiz platforms. Accordingly, the wage clause is a legal document allowing the worker or employer to submit a request for enforcement in the event of non-payment of wages. Importantly, there is no need for additional paperwork as verification is automatically completed through the link with the Madad platform.
This reliable mechanism enhances the speed of processing and contributes to facilitating access to rights while raising levels of compliance. The employment contract must be documented using the Qiwa platform and an implementation number should be obtained from the Ministry of Justice’s documentation centre. If the worker doesn`t receive wages within 30 days of the due date, they can appeal through the Najiz platform.
